Physicians Against the Quarry - Temecula Area Doctors Speak About the Health Risks

More than 160 Temecula Valley-area physicians have joined a coalition against the proposed Liberty Quarry. This video contains interviews with seven of them who detail the very real and very serious health risks that building a quarry would bring to the several hundred thousand residents of this area. Crystalline silica, asbestos, heavy metals and other toxic substances released by the daily blasting of rock, would travel through the air and into residents' lungs, causing deadly silicosis, mesothelioma (an aggressive form of lung cancer), diabetes, neurological disorders, genetic changes and other serious illnesses. These doctors are gravely concerned that this possible quarry would seriously affect the health of their most vulnerable patients (such as those with asthma and other issues) as well as that of healthy people. Dangerous Asbestos Types

Asbestos is a fiber that's mined from the ground. There are three primary types of asbestos that are used in industry. Chrysotile asbestos, which is the most common. amosite, and crocidolite. In the United States 95% of all asbestos products were made out of chrysotile asbestos. Asbestos that came from Canada. Less than 5% were made out of amosite asbestos, and almost none of the products used in the United States were made out of crocidolite. It's not surprising is it? That the defendants in the asbestos litigation, 95% of whom made chrysotile products contend in court that chrysotile is a "friendly fiber." It doesn't cause disease. And that all of the asbestos disease in America, especially mesothelioma, is caused by the other 4% or 5% of asbestos manufacturers. This defense has been defeated in the Newport News circuit courts many times, but in every one of our trials, this is an issue that we have to contend with, because the asbestos industry has a cottage industry of experts who'll come into court and say that their product was not harmful to you. Fortunately for our clients, the government has researched this issue. OSHA. EPA. The World Health Organization. And medical journals all over the world have concluded that chrysotile does cause mesothelioma. That amosite causes mesothelioma. That crocidolite causes mesothelioma. Interviewer: You told me you spent nine years in the US military, in the army. How do you think that has affected or influenced the way that you practice law? Asbestos: Harming Your Body

When microscopic asbestos fibers are released into the air, you breathe those fibers just like you would breathe any other dust that might be in the air. The first thing that happens is that the defense mechanisms in your body -- the hairs in your nose, the cilia in your throat, and the macrophages in your lungs -- try to remove these foreign particles from your body. Unfortunately, asbestos has some very unique characteristics that overcome your body's normal defense systems. The first is that they are very thin, and very small. And so they go beyond the hairs in your nose, the cilia in your throat, and they get into your lungs. The fibers then frequently break down into even smaller fibers. These fibers do one of two things. They either stay in the lungs where scar tissue develops around those fibers, just like if you had a splinter in your finger and you couldn't get it out. What would happen would be a scar would develop over that splinter. Well, in your lungs, millions and millions of scars are formed in a very microscopic way until those scars eventually become so dense that an asbestosis victim can't breathe. Or those fibers in the lungs turn to cancer. Lung cancer. That's the cancer inside your lung. Or those fibers migrate from your lungs into the lining of your lung -- the pleura. Latency Period for Asbestos Diseases

You know, everyone knows what latency is. If I have a cold and you're exposed to me, two or three or four days later you may get a cold. The latency for a cold is only two, three, or four days. Unfortunately, for asbestos-related diseases, the latency between the time you breathe asbestos and the time you manifest a disease or you're diagnosed with a disease is twenty, thirty, forty, even fifty years after the exposure occurs. This is why people use these products for so long. Because they never had any idea at the time they were using these products, breathing the dust, that the dust was hurting them in any way, because it would be twenty, thirty, forty years before the affects of breathing that dust caused them to develop a cancer. Forms of Mesothelioma

There are two primary types of mesothelioma. The first is a malignant cancer of the lining of the lung, which the doctors call pleura. The second is a malignant cancer of the lining of the abdomen, and they call that the peritoneum. So there's peritoneal mesothelioma, and there's pleura mesothelioma. The one thing they both have in common is that they're both caused by asbestos. The one thing that they also have in common is that the prognosis is the same.

Investigating Asbestos Related Injuries

When you're an asbestos trial lawyer, you receive calls from people who've received a diagnosis of an asbestos-related disease. The first question they ask you is do I have a case? It's not a simple question. When we get calls from clients who want us to investigate an asbestos-related disability, we go through a number of investigative steps that are required in every case. The first thing we do is confirm the diagnosis independently with pathologists, with pulmonary specialists, who look at the pathology or review the records to make sure that in fact this is an asbestos-related diagnosis. To make sure that this is mesothelioma and not some other cancer, and that is often an issue that can be controverted. Once we determine that the victim really does have an asbestos-related disease, we then have to determine who's responsible. That requires investigation. Not only the investigation of the memory of our client -- and many times they're gone, they've died before the family ever came to us -- but the memory of his coworkers. The records of his employer. So we get the medical records of the client. We get the employment records of the client. We call his coworkers. And we look into all the various ways that we can find out which asbestos products were used by him, which asbestos products were used around him, and which asbestos products are now manufactured by companies who can be sued and who can compensate our client. The public health background has been as important to me as my law background in terms of how I represent my clients. If you have ever sat in on a mesothelioma case, it will seem like it is parade of experts. It is almost a battle of the experts so, and having this sort of background, understanding how to read literature, understanding what methodology should be followed, helps me get my experts' points across about why our clients have been damaged and why they should be compensated, and also helps me attack the false reasoning of the defense experts who really do not follow accepted scientific protocols in reaching their conclusions that our people have not be harmed by asbestos.

Encapsulated Asbestos Fibers

I frequently hear defense attorneys tell juries my client's product is not dangerous because the asbestos in my client's product was encapsulated. These defenses have no legitimacy whatsoever. If you take a microscope and you look at the surface of everyone of these products, you'll see that the fibers were not encapsulated. The asbestos fibers are lying right there on the surface, but they're microscopic. And every time one of these products is used, it usually requires that it be cut, it be sanded, it be mixed, it be sawed. And whenever these activities are performed on an asbestos product, those fibers are released into the air in the millions. But you'll never see those fibers unless you have a special beam of light, what they call a tindle light that helps you to see it. With your naked eye, it's totally invisible. So the companies who make these products want juries, and they want you, to think that their product was not dangerous because it was "encapsulated." Asbestos is never encapsulated when it's used in its intended fashion.

Second Hand Mesothelioma

The first client that I ever represented who had an asbestos disease was Robert Vandyke. The year was 1975. Robert came to me with asbestosis. And I thought that asbestos was something only affected people who worked with asbestos products. The next year his wife developed mesothelioma, and that's when I learned that mesothelioma, which is a cancer of the lining of your lung, can be caused by very short and very low exposure to asbestos. Exposure that comes from a wife who simply washes her husband's clothes. From a wife who vacuums up the dust that falls onto her rugs or her floors from her husband's clothes. Lula Vandyke had mesothelioma, but she was only the first here in Newport News. We have represented forty-two people who never used asbestos, never worked with asbestos. They were family members of workers in the shipyard or workers in the industry who handled asbestos as part of their usual jobs. These family members -- brothers, wives, and children -- became victims of mesothelioma from the asbestos that was brought into their homes, even though they never worked with the product in their entire life.

Responsible Parties in Asbestos Litigation

The companies that are named as defendants in asbestos litigation are not the companies that the asbestos victim may have been familiar with in the last ten years or the last twenty years. Because asbestos diseases have a long latency period, usually thirty or forty years. So our job is to reconstruct all the various asbestos products that a mesothelioma victim, or a lung cancer victim, or an asbestosis victim may have worked with or around thirty and forty years ago. This means that we usually end up with a dozen or two dozen different companies who are named as defendants in these cases. And it also means that there's a lot of research and a lot of investigation that goes into determining who's responsible for any one individual's asbestos-related disease.
